These Service Agent Terms and Conditions (“Terms”) govern the use of TrailerHire.com’s platform by Service Agents ("You") offering services such as trailer hire, skip hire, van and driver services, and driver and trailer services. By using TrailerHire.com, you agree to these Terms.
1. Governing Terms and Conditions
1.1. Your contract with TrailerHire.com (the “Service Agent Contract”) consists of:
These Terms;
The Website Terms of Service;
The Rental Terms Terms and Conditions and
The Privacy Policy.
1.2. The Service Agent Contract creates binding and enforceable legal obligations between You and TrailerHire.com.
1.3. The Service Agent Contract is governed by the laws of England and Wales. Courts in this jurisdiction have non-exclusive authority to resolve disputes.
1.4. The Consumer Rights Act 2015 and other relevant UK consumer protection laws apply to these Terms.
1.5. TrailerHire.com may amend these Terms upon reasonable notice. Changes will take effect 7 days after the date of notification.
2. Role of TrailerHire.com
2.1. TrailerHire.com operates as a marketplace connecting Service Agents with customers ("Renters").
2.2. TrailerHire.com does not own the trailers, skips, or vehicles listed on the platform.
2.3. TrailerHire.com is not a party to the rental agreements between You and the Renters but facilitates the process.
3. Services Offered
Service Agents may offer:
Trailer Hire: Standard trailers, specialist trailers, advertising trailers, food trailers, and enclosed trailers.
Skip Hire: Domestic, commercial, and industrial waste management skips.
Van and Driver Services: Transport solutions for customers who cannot or prefer not to drive or lack the vehicle for their needs.
Driver and Trailer Services: For customers needing assistance with towing services.
4. Obligations of Service Agents
4.1. Equipment and Service Standards
4.1.1. You warrant that:
All equipment is in roadworthy condition and complies with legal requirements.
Descriptions and photographs in listings are accurate and include all relevant details, including any flaws or defects.
All required registrations, insurance, and certifications are up to date.
4.1.2. For van and driver services, drivers must:
Hold a valid UK driving licence suitable for the vehicle being used.
Comply with all road traffic laws.
Have the appropriate insurance for their services offered.
4.1.3. For skip hire services, skips must be:
Suitable for their intended purpose and free from hazardous materials or defects.
4.2. Listings and Availability
4.2.1. Listings must include:
Accurate service descriptions, fees, and any specific terms.
Availability for a minimum of 3 months annually.
4.2.2. You must:
Accept or decline booking requests promptly.
Update TrailerHire.com of any changes to availability or service updates.
4.3. Handover Procedures
4.3.1. Trailers and skips must be clean, fully functional, and free from personal items at handover.
4.3.2. You must demonstrate the safe operation of any equipment to the Renter and:
Verify the Renter’s identity using their driver’s licence or another approved form of ID.
Take high-definition photographs of equipment at handover and return.
4.4. Compliance and Insurance
4.4.1. Service Agents are responsible for maintaining appropriate insurance coverage for all services and equipment offered.
4.4.2. You must comply with all applicable laws and regulations, including waste disposal regulations for skip hire services.
5. Financial Terms
5.1. Payments
5.1.1. Customers pay TrailerHire.com the full Rental Fee, which includes:
Your Service Fee;
TrailerHire.com’s platform fee.
5.1.2. TrailerHire.com will transfer your Service Fee via electronic funds transfer within 3-5 business days after the booking date has past.
5.2. Cancellations
5.2.1. Customers may cancel bookings as per the Rental Terms and Conditions. If a booking is canceled:
More than 24 hours before the start time: You will not receive payment.
Less than 24 hours before the start time: You may receive a portion of the Service Fee, as outlined in your agreement.
5.2.2. If You cancel a confirmed booking, You may be subject to a cancellation fee.
6. Liability
6.1. Customer and Service Agent Responsibilities
6.1.1. You are responsible for:
Ensuring the safety, legality, and suitability of the equipment or services provided.
Addressing any damage or defects reported by the Renter.
6.1.2. TrailerHire.com is not liable for:
Damage to property or personal injury arising from the use of services or equipment.
Misrepresentation or non-performance by Service Agents or Renters.
6.2. Dispute Resolution
6.2.1. TrailerHire.com may mediate disputes but is not responsible for resolution outcomes.
7. Reporting Issues
7.1. Report any incidents, including damage or disputes, to TrailerHire.com within 24 hours.
8. Termination
8.1. Either party may terminate this agreement with 7 days’ written notice.
8.2. TrailerHire.com may terminate this agreement immediately if:
You breach these Terms;
You provide unsafe or unsuitable equipment or services.
9. Data Protection
9.1. TrailerHire.com processes personal data in accordance with its Privacy Policy.
10. Amendments
10.1. TrailerHire.com reserves the right to update these Terms. Continued use of the platform constitutes acceptance of updated Terms.
